Mr. Pearson made the motion to reconvene the September 17, 2008, meeting to continue budget talks. Mr. Thompson seconded the motion and on voice vote the chair declared the motion carried.

WARREN COUNTY ILLINOIS
STATEMENT OF TAX LEVIES
Year Ending November 30, 2009
WHEREAS, the County Board of Warren County, in the State of Illinois, in a session of the Regular November term A.D. 2008 held on the Twentieth day of November, said County Board members have determined the amount of all taxes
necessary to be levied for County General Purposes, which includes County
General, Working Cash, Warren County Retirement, Social Security, Tort, Workman's Compensation, Audit, Indigent Veterans, Mental Health Board, Extension Education, TB Care; County Highway Purposes which includes County Highway, Matching Tax; and for the payment of the ordinary and necessary expenses of said County of Warren for the fiscal year beginning December 1, 2008, and ending November 30, 2009.
THEREFORE, BE IT RESOLVED by said County Board of Warren County that the sum of Two Million Eighteen Thousand Five Hundred Dollars and no/100, ($2,018,500.00) being the total amount of the appropriation legally made which is to be collected from the tax levies of Warren County for the fiscal year beginning December 1, 2008, and ending November 30, 2009, be and is hereby assessed and levied upon and against all the taxable property within said Warren County in the State of Illinois, as is the same as or may be assessed and equalized as provided by law for the year A.D. 2008, and the County Clerk of said Warren County, in the State of Illinois, is hereby directed to extend and assess the sum of Six Hundred Ten Thousand Dollars and no/100 ($610,000.00) for County General purposes against and upon all the taxable property in said Warren County, in the State of Illinois, in the regular and usual manner of extending taxes against all the taxable property within said Warren County, in the State of Illinois, as the same is or may be assessed and equalized for taxation for the year 2008 for the specific amount and for the objects and purposes as follows to-wit:

THEREFORE, BE IT RESOLVED, that the following is a Tax Levy of Warren County, for the fiscal year beginning December 1, 2008, and ending November 30, 2009, to be assessed and levied upon and against the taxable property within the Ambulance District of said Warren County in the State of Illinois, and is the same as or may be assessed and equalized as provided by the law for the year A.D. 2008.

Mr. Harper made the motion to approve the changes to the agenda. Mr. Turnbull seconded the motion and on voice vote the chair declared the motion carried.

PRESENTATIONS FROM THE FLOOR
A. Jolene Willis, Executive Director of the Western Illinois Economic Development Partnership informed the board about an upcoming wind workshop on December 16 that W.I.E.D.P. is cosponsoring. Mrs. Willis updated the board on the Ecopoint project. The project has doubled to a 200 megawatt project. W.I.E.D.P. is working with the University of Illinois Extension on a booklet for the county farm wind project. The project is on track and they have one year of wind information. Mrs. Willis also updated the board about working with Senator John Sullivan’s office on the $86,000 elevator grant application.

B. Solid Waste Coordinator Chad Braatz informed the board about several items of interest concerning solid waste. The Swan Township cleanup was October 25 and over five tons of metal items were collected but there was a low turnout of paint and electronic recyclables. Mr. Braatz completed the Illinois Environmental Protection Agency compost renewal last week for the city of Monmouth. The village of Alexis had a focus group meeting to reduce the number of haulers and the pickup days and increase the options of solid waste management to include curbside recycling. Collection of unwanted medications is going well. Mr. Braatz distributed a Warren County facility totals report showing collections of the different types of recycles.

C. Jenna Link, Health Department Administrator, reported that the flu clinics are going well and the attendance was low for the “Fight Like a Girl” event for breast cancer. A chickenpox outbreak is being investigated. “Jump Girl Jump” for osteoporosis event is being planned.

November 12, 2008
Bill Thompson opened the meeting at 4:04 P.M. Others present were committee members Steve Johnson, Robert Cokel, Marvin Hawk, Scott Gibson, Board Chairman Bill Reichow, Kevin Smith, and John Livingston.
Smith added Floyd Township Bridge Agreement to the agenda. Hawk made a motion to approve the agenda. Johnson seconded the motion and it passed unanimously.
Gibson made a motion to accept the October minutes. Cokel seconded the motion and it passed unanimously.
The monthly bills were reviewed. Cokel made a motion to approve the monthly bills. Hawk seconded the motion. All yeas.
Under New Business:
The County Engineer showed the committee a copy of the Floyd Township Bridge Agreement from Hanson Professional Services, Inc. for the design of said bridge which would cost $27,500.00. Smith informed the committee that he hadn’t had enough time to thoroughly review the agreement, but would in the near future. Discussion followed. The opinion of the committee was that the cost was extremely expensive, and if Hanson couldn’t lower the cost, the committee thought it would be a good idea to negotiate with another engineering firm. Smith said he would review IDOT’s consultant selection process to make sure the county follows the correct procedures. No motion made.
The meeting adjourned at 5:52 P.M. on a motion by Gibson, seconded by Hawk.

The committee met in conjunction with the Road and Bridge Committee.
Johnson made a motion to approve the agenda. Gibson seconded the motion and it passed unanimously.
The October minutes were reviewed. Cokel made a motion to approve the minutes. Gibson seconded the motion and it passed unanimously.
The monthly bills were reviewed. Cokel made a motion to approve the bills. Johnson seconded the motion and it passed unanimously.
John Livingston showed the committee a list of suggestions he had put together for changing the kennel fees in Warren County. Discussion followed. Hawk made a motion to allow John Livingston and Nancy Clayton to draft a letter and send it to all kennel owners to invite them to next month’s meeting for a discussion in regards to raising kennel fees. Johnson seconded the motion and it passed unanimously.

The meeting was called to order by Committee Chairman Russell Stanton at 9:30 A.M. Present were all committee members and County Board Chairman Bill Reichow.
PRESENTATIONS FROM THE FLOOR
Jenna Link, Health Department Administrator, reported to the committee that the department is still doing flu clinics. Tonight from 4:00 P.M. - 7:00 P.M. at the Farm Bureau building is their breast cancer awareness event “Fight Like A Girl”. And she reminded the committee that they need to approve the FY 09 Health Department budget.
REPORT OF OFFICEHOLDERS
Circuit Clerk Denise Schreck had no report.
Nancy Clayton, Treasurer, noted the Hotel/Motel fund balance is $3,812.80. She is guessing the balance for county general is around 660,000 and she is working on the final distribution which will give another $120,000 to county general.
Sheriff Martin Edwards reported that he is posting a custodial position opening on the union bulletin boards and is working on an ad for the newspaper. After some discussion on the position it was noted that Jim Hart will maintain his electrical and maintenance contracts.
Janice Hamberg, Supervisor of Assessments, reported on an appeal hearing and her office will be looking at farmland again due to new legislation.


County Clerk Tina Conard reminded committee members that the November 19 board meeting has been changed to the Thursday the 20 and there will be no minutes to approve from the October meeting as her office has not had the time to get them done with the election being such a busy time. She also noted that she gave members copies of some information for them to read through.
OTHER
Mr. Stanton noted that Mr. Stivers has indicated he is not interested in giving an estimate for the R.O.E. building roof repairs. Mr. Stanton directed the county clerk to place an ad in the newspaper for bids, to be opened at the December committee meeting. Mr. Stanton also noted that he has not heard back from R.L. High on the continued repairs to the courthouse roof.
Mr. Winkler gave an update on his search for an appraiser for commercial real estate. It was noted that any appraisal is going to come with a fee. There was much discussion on the sale of several county owned properties.
Mrs. Starbuck moved to take to the board the consideration of selling the annex for a minimum of $475,000. Mr. Bresnahan seconded the motion. A roll call vote was taken with Stanton and Winkler “NO” votes and Starbuck, Bresnahan and Kinsel “YES” votes. The motion carried and will be on the agenda for the full board’s consideration. There was a question for an update on the lighting grant. Mr. Reichow noted that Mr. Hart will complete the labor. There was more discussion on the grant.
Bills were reviewed and paid on a motion by Mrs. Starbuck and seconded by Mr. Winkler.
With no further business, the meeting adjourned on a motion by Mrs. Starbuck and seconded by Mr. Winkler.

SALE OF ANNEX
Mr. Stanton asked for a motion to recommend to the board to put the annex on the market for sale at a price of no less than $475,000, which is essentially what we have invested.

Mrs. Starbuck made the motion to put the sale of the annex on the market for no less than $475,000 and Mr. Cokel seconded the motion. There was much discussion on the pros and cons of selling the annex. There was some concern about including a minimum figure in the motion.

Mrs. Starbuck then made the motion to amend her original motion and remove the price with the right to refuse any offers. Mr. Hawk seconded the motion for amendment and the following vote was taken:
Aye: Kinsel, Pearson, Reichow, Starbuck, Turnbull, Cokel, Hawk, Jenks, Johnson
Nay: Bresnahan, Harper, Stanton, Thompson, Winkler

FINANCE COMMITTEE MEETING
November 13, 2008
The meeting was called to order by committee chairman Mike Pearson. Present were Dave Jenks, John Turnbull, Gary Heaton and County Board Chairman Bill Reichow.
PRESENTATIONS FROM THE FLOOR
Jeff Stanton, Stanton/Ingersoll Agency and a representative from Illinois Public Risk presented the committee with the workman’s compensation renewal. County Clerk Tina Conard noted that the Animal Control classification needs to be removed from the computation as that is a contracted position that we no longer pay workman’s compensation. The renewal comes in just under $85,000.
REPORT OF OFFICE HOLDERS
County Clerk Tina Conard reminded the committee that the board meeting has been changed next week to Thursday and there will be no minutes to approve as her office has not had the time to type them.
Supervisor of Assessments Janice Hamberg reported that she has received some new aerial photographs, the cell tower assessments are done, the 2009 owner occupied exemption are going up another $500 and she has received one application for the Conservation stewardship program.
Treasurer Nancy Clayton noted the balance as of today for county general is $176,064.04. She feels the final distribution will be between $118,000 to $120,000 and hopes to have it out by the end of next week. She asked for approval to make the final payment to the health department with the final distribution. Mr. Heaton moved to allow the treasurer to pay the final FY08 payment to the health department. Mr. Jenks seconded the motion and on voice vote motion carried.
County Board Chairman Reichow reported on a meeting that he will be attending next week and mentioned that Jim Hart has turned in his resignation as custodian but he will maintain the electrical and maintenance contracts.
Bills were approved and paid on a motion by Mr. Turnbull and seconded by Mr. Jenks.
With no further business the meeting adjourned on a motion by Mr. Turnbull and seconded by Mr. Heaton.
The committee then went into budget preparation. Some line items were discussed and the levy was set to be presented to the board next week.

STRATEGIC PLANNING COMMITTEE
September 23, 2008
The meeting was called to order by appointed committee chairman Gary Heaton.
Mr. Heaton noted the reason for the creation of this committee was to come up with a plan if the public safety tax referendum passes and a plan if it fails.
Mr. Heaton opened the floor for ideas if the referendum fails. Some of the ideas presented were sale of property. Mrs. Starbuck explained the Building and Grounds committee decision not to sell the ROE building. A tele-communications tax, early retirement incentive for eligible employees, the solid waste contract, cutting a zoning co-administrator, county vehicles driven home by employees, taxing cell towers, raising building permits, permits on farm buildings, site inspection fees, WIEDP funding, impound vehicles, shortening courthouse hours, outfitter business fees.
Mr. Pearson gave some figures that he had summed up on shortening courthouse hours. The savings would be $23,086 for a one-half hour and $46,173 for an hour. These figures do not include office holders or janitor.
There was some discussion on the public safety sales tax.
After much discussion the following were assigned:
Janice Hamberg - taxing cell towers and courthouse hours for surrounding counties.
Mike Pearson - zoning permit fees (increasing fees, ag building fees and site inspection fees) and early retirement incentive
Gary Heaton - auto impound fees
Dave Jenks - solid waste contract
The discussion then went to “if” the tax passes. It was noted that funds won’t be seen until December 2009. Mr. Pearson noted that one deputy and one jailer for starters should be hired. The sheriff discussed the problems with not having enough jailers or deputies. The sheriff was asked to come up with some cost estimates. He noted that a new jailer could cost around $28,500 with training and uniform costs, but this figure did not include wage or personal benefits. A deputy with training, equipment and uniforms could run $60,000, again does not include wage or personal benefits. Sheriff Edwards also gave some call volume stats.
The next meeting was scheduled for September 30 at 6:00 P.M.

The strategic planning meeting held their second meeting, called to order by appointed chairman Gary Heaton. The committee discussed some of the information from the previous meeting.
Mike Pearson reported on the early retirement incentive. IMRF provided a list of current employees that would be eligible for this program. The cost could be paid in a five to ten year time frame. Another ERI could not be offered again until this program was paid off. It was not calculated out what the savings would or would not be, but several of the officers noted that their eligible employees would probably not take advantage of the offer.
Dave Jenks spoke on the solid waste program. He reviewed the contract and also spoke to Hancock County and Henderson County. Mr. Jenks discussed some of the information he found. He noted that he thought this agreement could be broken. He read the paragraph in the contract.
Janice Hamberg discussed taxing cell towers. She believes there would be ten to be taxed and noted that this tax would only bring in about $667 to county general.
Mike Pearson discussed building permit fees. Building permit fees defined in the statutes to farmers is a no permit fee. Mr. Algren noted that a site inspection fee was not allowable.
Gary Heaton checked on an auto impound fee. The States Attorney said this fee would have to be a reasonable fee and probably would not amount to very much money for the county. He also checked on outfitter licenses. They probably have to be licensed through the state and not knowing how many were in the county, probably would not generate a lot of money.
Janice Hamberg gave the committee copies of a list of surrounding counties’ hours. Mr. Pearson had reported last week that there could be a $23,000 savings if the courthouse hours were cut by one-half hour.
Mrs. Hamberg asked about increasing the levy and holding a truth in taxation hearing. It was noted that county general is at it’s max rate.
Mr. Jenks noted the cost of employees driving county vehicles home and out of the county.
Expected revenues were discussed. Mr. Pearson asked the sheriff how he could cut $50,000 out of his budget. The sheriff responded by noting that prisoner medical costs can now be paid from the Arrestees Medical Fund.
There was discussion on cutting costs, cutting services, the public safety tax, equalized assessed values, borrowing funds, sale of county property.
If the public safety tax passes, how will it be spent? Put monies aside for a new jail or repairs to the current jail. Bolster the Sheriff’s department for services to the citizens. The sheriff discussed his needs.
It was decided not to meet for the scheduled meeting for next Tuesday.

Mr. Pearson made the motion to approve the foregoing minutes of the Strategic Planning Committee. Mr. Thompson seconded the motion and on voice vote the chair declared the motion carried.

Chairman Reichow will ask the Strategic Planning Committee chairman to develop a series of meetings to address the possibility of putting the public safety tax back on the ballot for the April Consolidated Election.

RESOLUTION #33-07-08
ZONING CO-ADMINISTRATORS
AGREEMENT
PURPOSE:
This agreement is entered into between Warren county, Illinois, (hereinafter referred to as “County”) and Marcia K. McLaughlin and Tammy Davis (hereinafter referred to “Co-Administrators”), whereby the Co-Administrators shall administer County’s zoning ordinance and County’s plats on behalf of the County.
TERM:
This agreement shall commence December 1, 2008, and terminate November 30, 2009, inclusive. Either party may terminate this agreement early by giving sixty (60) days written notice to the other party. This agreement may be terminated at any time by the mutual agreement of the parties.
CONSIDERATION:
County shall pay each Co-Administrator $3,264 per year in consideration of administering County’s zoning ordinance and plats. Said compensation shall be paid in twenty-six (26) equal installments to be paid on County’s regularly scheduled pay days. The annual consideration shall be pro-rated should this agreement be terminated early.
DUTIES AND AUTHORITIES OF CO-ADMINISTRATORS:
1. To administer County’s zoning ordinance and plats in a prompt and timely fashion.
2. To maintain office hours that correspond with County’s.
3. To report to the County Board on a monthly basis. Such report will include the number and type of building permits issued in Warren County for the previous month and year to date and the approximate value of the structures represented by said permits.
4. To record the minutes of every meeting held by County’s Zoning Board of Appeals and Planning Commission.
5. To provide for site inspections at an annual rate not to exceed $5,000 per year.
6. To report to the Zoning Board of Appeals, Planning Commission, County Board and State’s Attorney regarding any problems or interpretation issues regarding the County’s zoning ordinance.
DUTIES OF COUNTY:
1. Provide the Co-Administrators with appropriate office space which will include a minimum of one (1) telephone line.
2. Provide the Co-Administrators with adequate office supplies.

RESOLUTION #34-07-08
CONTRACT FOR SERVICES BY ANIMAL CONTROL WARDEN
This Contract is made by and between Warren County, a duly constituted County of the State of Illinois (COUNTY) and John A. Livingston, Animal Control Warden (WARDEN), pursuant to Livingston’s appointment as WARDEN by Dr. Elizabeth D. McBroom and Dr. Mark F. Hall, Animal Control Administrators (ADMINISTRATORS) for the COUNTY as authorized by the COUNTY BOARD. (Illinois Animal Control Act, Illinois Compiled Statutes, Chapter 510, Act 5, Section 1 et. Seq.)
WARDEN, an independent contractor, and COUNTY mutually promise and agree to the terms of this contract as follows:
1. DURATION AND TERMINATION OF CONTRACT:
A. This contract shall begin on December 1, 2008, and terminate on November 30, 2009, inclusive.
B. WARDEN or COUNTY may otherwise terminate this contract upon thirty (30) days written notice to the other party. Notice of termination pursuant to this subsection shall be made by personal service or via first class mail service.
C. Upon a breach of this contract, the non-breaching party may terminate this contract upon thirty (30) days written notice to the breaching party. Notice of termination pursuant to this subsection shall be made by personal service or via first class mail service. Notice of termination pursuant to this subsection shall become ineffective if the breaching party cures the breach within the thirty (30) days notice period.
2. COMPENSATION:
A. WARDEN shall receive compensation from COUNTY of twenty-six thousand dollars ($26,000) for the duration of this contract.
B. Payment shall be made in equal installments beginning Friday, December 12, 2008, and thereafter every other Friday.
C. Payment shall be made the first Friday of regularly scheduled payment upon early termination of this contract pro rated to the date early termination became effective.
3. PERFORMANCE BY WARDEN:
A. WARDEN shall devote as much time as reasonably necessary to fully perform WARDEN’S duties as required by the ADMINISTRATORS, COUNTY ordinances and the laws of the State of Illinois.
B. WARDEN may contract with other units of local government to provide animal control services.
4. VEHICLE AND VEHICLE ALLOWANCE:
A. WARDEN shall provide a vehicle that will allow WARDEN to reasonably perform the duties required under this contract.
B. WARDEN shall pay for all expenses related to the vehicle WARDEN has provided pursuant to this contract.
C. WARDEN shall purchase and keep in effect liability insurance on the vehicle provided by WARDEN pursuant to this contract. WARDEN shall provide COUNTY with proof of liability insurance. The minimum limits of such liability coverage shall be set by COUNTY.
D. WARDEN shall be paid a vehicle expense allowance of eight thousand four hundred dollar ($8,400). Payment shall be made in equal installments beginning December 12, 2008, and thereafter every other Friday.
5. UNIFORMS AND EQUIPMENT:
A. COUNTY shall provide WARDEN with the following uniform clothing:
i. $100 per year clothing allowance
B. Patches for shirts, cap and jacket or coat that identifies WARDEN as WARREN COUNTY ANIMAL CONTROL WARDEN.
C. Uniforms and equipment shall be replaced on an as needed basis as determined by the ADMINISTRATORS and/or the Animal Control Warden.
D. All uniforms, equipment and patches purchased pursuant to this section are and shall remain the property of COUNTY.





6. EDUCATION AND TRAINING:
A. COUNTY shall pay the WARDEN’S initial training as required by the laws of the State of Illinois. Said training costs will be prepaid or reimbursed to WARDEN in an amount not to exceed one thousand two hundred dollars ($1,200). Payment shall cover the cost of tuition, mileage, housing and food. WARDEN shall provide adequate proof of costs to COUNTY to receive reimbursement or prepayment.
B. WARDEN shall reimburse COUNTY the cost of initial training as a rate of one- twenty fourth (1/24) for each month less than twenty-four (24) consecutive months that WARDEN is not under contract with COUNTY. Reimbursement shall be paid to COUNTY within thirty (30) days of termination of non-renewal of this contract.
C. WARDEN may attend one continuing education animal control program per year at COUNTY’S expense thereafter. Attendance at such animal control program shall be approved by the ADMINISTRATORS.
7. MISCELLANEOUS:
A. WARDEN shall be in uniform at all times while conducting animal control duties except under emergency situations where the changing of clothing would prevent WARDEN from promptly responding.
B. WARDEN shall provide for emergency animal control with a qualified individual or individuals during WARDEN’S absence. Said individual or individuals shall be approved by the ADMINISTRATORS.
C. WARDEN shall be responsible for all Federal, State and Local taxes and assessments accrued as a result of this contract.
D. WARDEN shall not be covered by COUNTY’S Workmen’s Compensation or eligible for any of COUNTY’S employee benefits.
E. This contract represents the entirety of the agreement for animal control between WARDEN and COUNTY. Modifications of this contract shall be in writing and will not require additional consideration.
8. SEVERABILITY:
A. Any part or parts of this contract that are found to be unlawful by decision of Illinois or United States Courts or by a change in Illinois or United States law shall have no effect on the remainder of the contract.

AGREEMENT IN REGARD TO SERVICES OF
CO-ANIMAL CONTROL ADMINISTRATORS
THIS MEMORANDUM EVIDENCES an Agreement made between Warren County, a duly constituted County of Illinois, hereinafter referred to as "COUNTY," and Dr. Elizabeth D. McBroom and Dr. Mark F. Hall, Veterinarians, hereinafter referred to as "CO-ADMINISTRATORS,"
Whereas, Warren COUNTY, pursuant to recently enacted statutes is required to provide for an Animal Control Program, and
WHEREAS, said CO-ADMINISTRATORS shall provide a service as hereinafter mentioned in this Agreement for the County in return for the compensation provided herein.
NOW THEREFORE, the undersigned in consideration of their mutual promises, herein agree that:
1. The term of this agreement shall be from the 1st day of December, 2008, to and
including the 1st day of December, 2009.
2. That, for the terms of this Agreement, said CO-ADMINISTRATORS shall receive a
payment in the amount of One Thousand Eight Hundred and no/100 Dollars
($1,800.00), to be paid by the COUNTY over a twelve (12) month period, or as
otherwise agreed until the termination of this Agreement.
3. The CO-ADMINISTRATORS shall be responsible for the complete administration of the
animal control for Warren COUNTY, except those municipalities and villages
providing a satisfactory program of animal control in regard only to an animal
program at large, but not as to rabies control.
4. The CO-ADMINISTRATORS shall delegate all duties and supervise all work of the
Animal Control Warden.
5. This Agreement shall incorporate all applicable provisions of the Illinois Animal
Control Act effective October 1, 1978, and any subsequent law thereafter
applicable to the subject matter of this agreement.

RESOLUTION #36-07-08
CITY/COUNTY JOINT ANIMAL CONTROL CONTRACT
AGREEMENT
THIS AGREEMENT entered into this 20th day of November, 2008, between the City of Monmouth, a Municipal Corporation, located in the County of Warren, State of Illinois, hereinafter referred to as "CITY", and the County of Warren, a Political Subdivision of the State of Illinois, located in the State of Illinois, hereinafter called "COUNTY".
WHEREAS, CITY AND COUNTY individually have certain responsibilities for control and/or care of abandoned or stray cats and dogs as required by local ordinance and/or State Statutes and
WHEREAS, CITY AND COUNTY desire to provide for the care of abandoned or stray cats and dogs in the most economical manner for the residents of their respective jurisdictions, and
WHEREAS, CITY AND COUNTY have, for the past several months, jointly operated an animal control shelter, which shelter was constructed by the COUNTY on land owned by the CITY, and
WHEREAS, CITY AND COUNTY desire to share said facility for the care of abandoned or stray cats and dogs.
NOW THEREFORE, in consideration of the mutual covenants and stipulations set forth herein, it is agreed as follows:
1. That CITY AND COUNTY will continue to jointly use the animal control shelter facility located in the City of Monmouth for the purpose of housing and caring for stray or abandoned cats or dogs, or cats and dogs running at large in violation of local ordinance and/or State Statute.
2. That CITY AND COUNTY shall, not less than quarterly, provide the other party with a written statement clearly showing all receipts and expenditures incurred in the operation of the shelter for the previous calendar quarter. The party with the least net operating expense for the preceding calendar quarter shall pay to the party
with greatest net operating expense a sum equal to one-half (1/2) of the difference shown on the respective quarterly statements. Said payment to be made within thirty (30) days of the end of each calendar quarter.
3. That the COUNTY'S income and expenses incidental to the issuance of dog licenses be wholly retained and borne by the COUNTY. 4. That the CITY'S income and expenses incidental to the issuance of cat licenses be wholly retained and borne by the CITY.
5. That each party to this Agreement shall assume and hold the other harmless for any and all liability arising by reason of the acts of their respective employees in the performance of this Agreement THIS INSTRUMENT contains the entire agreement between the parties and no statement, promises, or inducements made by either party or agent of either party that is not contained in this written contract shall be valid or binding; and this Agreement may not be enlarged, modified, or altered except in writing signed by the parties and endorsed thereon.
THIS AGREEMENT shall insure to the benefit and be binding upon the assignees and successors of the respective parties until November 30th, 2009. Notice of termination must be thirty (30) days before the expiration of contract by either party.

LEGAL COUNSEL FOR INDIGENTS AGREEMENT
This Agreement is entered into this 20th day of November, 2008, by and between the County of Warren, a political subdivision of the State of Illinois located in the State of Illinois, hereinafter referred to as "Warren County" and Stansell, Whitman & Baber acting only through Thomas Siegel, an attorney duly licensed to practice law in the State of Illinois, hereinafter referred to as "Thomas Siegel";
WITNESSETH:
WHEREAS, Warren County is desirous of contracting with independent counsel to provide legal services to indigent and juvenile persons appearing in criminal, juvenile and traffic cases in the courts of Warren County; and
WHEREAS, Thomas Siegel is an attorney desirous of contracting through Stansell, Whitman & Baber, on an independent basis, with Warren County to provide legal services as specified herein;
NOW THEREFORE, WARREN COUNTY and Thomas Siegel through Stansell, Whitman & Baber agree as follows:
1. TERM: The term of this Agreement shall be from December 1, 2008, to November 30, 2009.
2. PAYMENT: WARREN COUNTY agrees to pay to Thomas Siegel the sum of $70,000, to be paid in 26 equal payments, the first of which shall be made on December 15, 2008, and continuing thereafter every two weeks until termination of this Agreement.
3. SERVICES: In consideration of the payments set forth herein, Thomas Siegel agrees to provide legal services to indigents and juveniles in criminal and juvenile cases in the courts of Warren County, upon appointment by the Court. Cases are to be assigned as follows:
A. All felony cases, subject to the exceptions set forth below.
B. All misdemeanor cases, except driving offenses unless a related felony is also charged.
C. All Juvenile cases where a conflict exists for the alternate independent counsel who contracts with Warren County for representation of indigent persons and juveniles and in all juvenile cases where more than one attorney is appointed.
D. Exceptions:
I. Thomas Siegel is not responsible for representation of defendants in traffic, first degree murder or capital cases.
II. Thomas Siegel is not responsible for representation of defendants in civil actions or administrative proceedings brought by Warren County or the State of Illinois, including, but not limited to, forfeiture, condemnation, IMDMA cases and matters relating to licenses.
III. Thomas Siegel is not responsible for representation of defendants taking cases on appeal.
IV. Cases for which Thomas Siegel has a conflict of interest.
E. Should Thomas Siegel be appointed by the Court to represent defendants in any cases from which he has been excepted, Thomas Siegel will bill Warren County for reasonable fees for such representation.
4. LEGAL SERVICES: Legal services to be provided shall be those services ordinarily and customarily provided by a public defender to persons in criminal and juvenile cases, both prior to and through trial in the courts of Warren County.
5. SUPPORT SERVICES: Thomas Siegel shall provide and pay for all assisting counsel, support staff, secretarial assistance, supplies, material, travel (unless venue is changed by the court), equipment, and office expense unless otherwise ordered by the Court. This shall not include costs for subpoenas or expert witnesses or other costs directly related to an individual case.
6. TERMINATION: This Agreement may be terminated by either Warren County or Thomas Siegel upon 60 days written notice.
7. WITNESS SUBPOENA ACCOUNT: Thomas Siegel will advance money for witness and mileage fees related to the issuance of subpoenas and will then periodically submit a statement to the Warren County Treasurer for reimbursement of the advanced above mentioned fees.

LEGAL COUNSEL FOR INDIGENTS
THIS AGREEMENT is entered into this 1st day of December, 2008, by and between the County of Warren, a political subdivision of the State of Illinois located in the State of Illinois, (hereinafter referred to as "Warren County") and SHERRY R LAWSON, an attorney duly licensed to practice law in the State of Illinois, (hereinafter referred to as "Lawson”);
WITNESSETH:
WHEREAS, Warren County is desirous of contracting with independent counsel to provide legal services to indigent and juvenile persons appearing in criminal, juvenile and traffic cases in the courts of Warren County; and
WHEREAS, SHERRY R LAWSON is an attorney desirous of contracting, on an independent basis, with Warren County to provide legal services as specified herein;
NOW THEREFORE, WARREN COUNTY and Sherry R Lawson agree as follows:
1. TERM: The term of this Agreement shall be from December 1, 2008, to November 30, 2009.
2. PAYMENT: WARREN COUNTY agrees to pay to Sherry R Lawson the sum of $39,720.00 to be paid in 12 equal payments, once a month, until termination of this Agreement.
3. SERVICES: In consideration of the payments set forth herein, LAWSON agrees to provide legal services to indigents and juveniles in criminal, juvenile and traffic cases in the courts of WARREN COUNTY, upon appointment by the Court. Cases are to be assigned as follows:
A. All felony cases, subject to the exceptions set forth below, in which Warren County’s Independent Counsel, whose primary duty is to represent felony defendants, has a conflict.
B. All misdemeanor cases in which Warren County’s Independent Counsel, whose primary duty is to represent misdemeanor defendants, has a conflict.
C. All Juvenile cases in which LAWSON does not have conflict. With regard to juvenile neglect and abuse cases, LAWSON shall be first appointed as Guardian Ad Litem whenever possible.
D. All traffic cases in which Sherry R Lawson does not have a conflict.
E. Exceptions:
I. LAWSON is not responsible for representation of defendants in first degree murder or capital cases.
II. LAWSON is not responsible for representation of defendants in civil actions brought by Warren County or the State of Illinois.
III. LAWSON is not responsible for representation of defendants taking cases on appeal.
F. Should Lawson be appointed by the Court to represent defendants in any cases from which she has been excepted, Lawson shall bill Warren County for reasonable fees for such representation.
4. LEGAL SERVICES: Legal services to be provided shall be those services ordinarily and customarily provided by an attorney to persons in criminal, juvenile and family cases, both prior to and through trial in the courts of Warren County. Representation shall end thirty (30) days after sentencing or conviction or immediately upon dismissal of a case.
5. SUPPORT SERVICES: Sherry R Lawson shall provide and pay for all assisting counsel, support staff, secretarial assistance, supplies, material, travel, equipment, and office expenses unless otherwise ordered by the Court.
6. COURT APPEARANCES: Court appearances for Lawson shall be set only on Tuesdays and Wednesdays each week, with the exception of jury trials and the jury pretrial hearings as set by the criminal jury judge.
7. VACATIONS: Lawson shall be entitled to three (3) weeks of vacation per year. Lawson shall be paid during those vacation periods and shall not have to provide coverage for those periods. Warren County shall keep those vacation periods free from all court appearances. Lawson shall provide a minimum of two (2) weeks notice to Warren County of her intention to schedule vacation time. Vacation shall be taken either consecutively or non-consecutively.




8. TERMINATION: This Agreement may be terminated by either WARREN COUNTY or SHERRY R LAWSON upon 60 day written notice.

STATE'S ATTORNEYS APPELLATE PROSECUTOR
AMENDED
RESOLUTION
WHEREAS, the Office of the State's Attorneys Appellate Prosecutor was created to provide services to State's Attorneys in Judicial Districts containing less than 3,000,000 inhabitants; and,
WHEREAS, the powers and duties of the Office of the State's Attorneys Appellate Prosecutor are defined and enumerated in the "State's Attorneys Appellate Prosecutor's Act", 725 ILCS 210/1 et.seq., as amended; and,
WHEREAS, the Illinois General Assembly appropriates monies for the ordinary and contingent expenses of the Office of the State's Attorneys Appellate Prosecutor, one-third from the State's Attorneys Appellate Prosecutor's County Fund and two-thirds from the General Revenue Fund, provided that such funding receives county approval and support from within the respective Judicial Districts eligible to apply; and,
WHEREAS, the Office of the State's Attorneys Appellate Prosecutor shall administer the operation of the appellate offices so as to insure that all participating State's Attorneys continue to have final authority in preparation, filing, and arguing of all appellate briefs and any trial assistance; and,
WHEREAS, the Office of the State's Attorneys Appellate Prosecutor and the Illinois General Assembly have reviewed and approved a budget for Fiscal Year 2009, which funds will provide for the continued operation of the Office of the State's Attorneys Appellate Prosecutor.
NOW, THEREFORE, BE IT RESOLVED that the Warren County Board, in regular session, this 20th day of November, 2008, does hereby support the continued operation of the Office of the State's Attorneys Appellate Prosecutor, and designates the Office of the State's Attorneys Appellate Prosecutor as its Agent to administer the operation of the appellate offices and process said appellate court cases for this County.
BE IT FURTHER RESOLVED that the attorneys employed by the Office of the State's Attorneys Appellate Prosecutor are hereby authorized to act as Assistant State's Attorneys on behalf of the State's Attorneys of this County in the appeal of all cases, when requested to do so by the State's Attorney, and with the advice and consent of the State's Attorney prepare, file, and argue appellate briefs for those cases; and also, as may be requested by the State's Attorney, to assist in the prosecution of cases under the Illinois Controlled Substances Act, the Cannabis Control Act, the Drug Asset Forfeiture Procedure Act and the Narcotics Profit Forfeiture Act. Such attorneys are further authorized to assist the State's Attorney in the State's Attorney's duties under the Illinois Public Labor Relations Act, including negotiations thereunder, as well as in the trial and appeal of tax objections.
BE IT FURTHER RESOLVED that the attorneys employed by the Office of the State’s Attorneys Appellate Prosecutor may also assist State’s Attorneys of this County in the discharge of the State’s Attorney’s duties in the prosecution and trial of other cases, and may act as Special Prosecutor if duly appointed to do so by a court having jurisdiction.
BE IT FURTHER RESOLVED that the Warren County Board hereby agrees to participate in the service program of the Office of the State's Attorneys Appellate Prosecutor for Fiscal Year 2009, commencing December 1, 2008, and ending November 30, 2009, by hereby appropriating the sum of $7,000 as consideration for the express purpose of providing a portion of the funds required for financing the operation of the Office of the State's Attorneys Appellate Prosecutor, and agrees to deliver the same to the Office of the State's Attorneys Appellate Prosecutor on request during the Fiscal Year 2009.
