STATEMENT OF TAX LEVIES
Year Ending November 30, 2008
WHEREAS, the County Board of Warren County, in the State of Illinois, in a session of the Regular November term A.D. 2007 held on the Fourteenth day of November, said County Board members have determined the amount of all taxes necessary to be levied for County General Purposes, which includes County General, Working Cash, Warren County Retirement, Social Security, Tort, Workman's Compensation, Audit, Indigent Veterans, Mental Health Board, Extension Education, TB Care; County Highway Purposes which includes County Highway, Special Bridge Aid, Matching Tax; and for the payment of the ordinary and necessary expenses of said County of Warren for the fiscal year beginning December 1, 2007, and ending November 30, 2008.
THEREFORE, BE IT RESOLVED by said County Board of Warren County that the sum of Two Million One Hundred Three Thousand Dollars and no/100, ($2,103,000.00) being the total amount of the appropriation legally made which is to be collected from the tax levies of Warren County for the fiscal year beginning December 1, 2007, and ending November 30, 2008, be and is hereby assessed and levied upon and against all the taxable property within said Warren County in the State of Illinois, as is the same as or may be assessed and equalized as provided by law for the year A.D. 2007, and the County Clerk of said Warren County, in the State of Illinois, is hereby directed to extend and assess the sum of Six Hundred Thousand Dollars and no/100 ($600,000.00) for County General purposes against and upon all the taxable property in said Warren County, in the State of Illinois, in the regular and usual manner of extending taxes against all the taxable property within said Warren County, in the State of Illinois, as the same is or may be assessed and equalized for taxation for the year 2007 for the specific amount and for the objects and purposes as follows to-wit:

PRESENTATIONS FROM THE FLOOR
A. Roxie Lucas with the Quad Cities Visitors and Convention Bureau handed out a visitor’s guide noting that on page 51 and 52 that they had added a map of Warren County and surrounding counties along with a description of some places to visit. Ms. Lucas also handed out the Quad Cities R.O.I. newsletters. The State of Illinois has an international grant which the bureau has applied for. They have done this for several years to try and attract international tours beginning in Chicago and touring farm and agricultural business all over the state. The web site for the bureau is www.visitquadcities.com. Pam Ellis, who is also with the Quad Cities Visitors and Convention Bureau, reported that they are promoting Living Windows and are hoping in 2009 and 2010 to hold a pottery convention. June 28 is Pottery on the Square.
B. Ronald Moore, Chairman of the Zoning Board of Appeals, stated that he had been requested to talk about decommissioning language. He gave a brief history on the first hearing about the wind energy system in Warren County and the process of changing the zoning code. This decommissioning agreement is only for the current wind farm project.
RESOLUTION #35-06-07
WARREN COUNTY ZONING CODE
WIND ENERGY RESTORATION AGREEMENT
Whereas, the Warren County Board adopted a text amendment to the Warren County Zoning Code regarding wind energy systems on April 19, 2006. and;
Whereas, each wind energy system owner may or may not have a written decommissioning agreement included in the land lease and wind easement contract with each property owner. and;
Whereas, each wind energy system owner discussed decommissioning during the public hearing review process. and;
Whereas, each wind energy system special use permit approved by the Warren County Board may require financial assurances regarding restoration. and;
Whereas, the Warren County Zoning code, Section 150.100 (a.e.) states that financial assurance may be required to guarantee restoration (decommissioning) before a building permit will be issued. and;
Whereas, the Warren County Planning Commission/Zoning Board of Appeals recommends that Warren County require a Written Restoration Agreement and that said agreement include provision for financial assurance to guarantee restoration. and;
Whereas, the Planning/Development Committee of the Warren County Board recommends that Warren County require a Written Restoration Agreement and that said agreement include provision for financial assurance to guarantee restoration.
Whereas, the Warren County Planning Commission/Zoning Board of Appeals recommends as follows:
A. Restoration Agreement: Each wind energy system facility owner shall prepare, sign, notarize and submit a written restoration agreement for each wind energy system facility before a building permit can be issued. Written restoration agreement shall include:
1. Acknowledgment of wind energy system facility owner obligation and promise to complete restoration at a future date pursuant to the Warren County Zoning Code, Section 150.100 (a.e.)
2. Description of events that will initiate the restoration process.
3. Description of restoration process. (such as removal of wind turbines, above ground improvements, outdoor storage; removal of foundation pads and underground electrical wires to a depth of four (4) feet below the surface of the ground; removal of hazardous materials.)
4. Acknowledgment that failure to comply with conditions or restrictions imposed on a special use permit shall be deemed a violation of the Warren County Zoning Code.
5. Provision that the terms of the Restoration Agreement shall be binding upon the wind energy system facility owner and any successors, assigns or heirs.
6. Provision that in the case of restoration default by the wind energy system owner Warren County and its agents or designees shall have access to the wind energy system facility sites, pursuant to seasonal notice, to effect or complete restoration.
7. Provision for identification of and procedures for Warren County access to financial assurance provided by the wind energy system facility owner.
B. Certified Estimate of Restoration Costs. Restoration Agreement shall include a report estimating the wind energy system facility restoration costs certified by a Professional Engineer. Report should be similar in style and content to the Benson Wind Farm Decommissioning Report prepared for Navitas Energy, Inc. by STS Consultants, Ltd, dated July 2006.
C. Financial Assurance. Restoration agreement shall include a provision for financial assurance described as follows:
1. Acknowledgment of owner obligation and promise to provide financial assurance to Warren County in the amount of twenty-five thousand dollars ($25,000) per each large wind energy system (turbine) included in the permitted wind energy system facility twelve (12) years from the date the first wind energy system (turbine) begins generating electricity.
2. The financial assurance shall be increased to thirty thousand dollars ($30,000) eighteen (18) years from the date the first wind energy system (turbine) begins generating electricity. The financial assurance shall be increased to thirty- five thousand dollars ($35,000) twenty-four (24) years from the commercial operation date.
3. The wind energy system owner may provide a thirty-five thousand dollar ($35,000) financial assurance per each large wind energy system (turbine) in the permitted wind energy system facility twelve (12) years from the commercial operation date (instead of increasing the amounts to $30,000 and $35,000 as prescribed above) if the owner so chooses.
4. The financial assurance may be in the form of a performance bond, surety bond, letter of credit, corporate guarantee, or escrow account as long as the security is equal to or greater than a surety bond as determined by the Warren County
State’s Attorney.
5. Provision that if wind energy system facility restoration costs exceed salvage value and financial assurance amounts, the wind energy system facility owner, NOT WARREN COUNTY, shall be responsible for the difference.
D. State of Illinois. The State of Illinois has been working on restoration (decommissioning/restoration) legislation that would provide uniform restoration requirement for all wind energy system facilities located throughout the State. Proposed legislation may or may not become law and may or may not supersede local restoration requirement. Warren County will review legislation if and when it becomes law and will amend Restoration Agreement as necessary to make it compliant with the law as necessary.

C. Solid Waste Coordinator Chad Braatz informed the board about several items of interest concerning solid waste. The Illinois Removes Illegal Dumping program has started again and this time it is townships in McDonough County with Tompkins Township and Monmouth Township in Warren County scheduled for 2008. October’s unwanted meds collection was very successful. Swan Township cleanup was October 27. Mr. Braatz gave the results of the “Can Do Contest” and distributed a Warren County facility totals report showing collections of the different types of recycles.
D. Jolene Willis, Executive Director of the Western Illinois Economic Development Partnership informed the board that the partnership is working with the Village of Alexis doing an area survey on the possibility of a new grocery store. Mrs. Willis advised the board to continue to contact their legislators in support of the Capital Bill. WIEDP will be sending out a quarterly newsletter and they are forming a mayors council with mayors from area villages to work on economic development. Mrs. Willis reported that Fusion Tech has constructed a MET tower in Point Pleasant Township. Chairman Reichow commented on the Highway 336/67/34 meeting that he and Mrs. Willis had attended.

Kirkwood and Monmouth FEMA Reimbursement was added under new business. Gibson made a motion to approve the agenda. Cokel seconded the motion and it passed unanimously.
Johnson made a motion to accept the October minutes. Gibson seconded the motion and it passed unanimously.
The monthly bills were reviewed. Johnson made a motion to approve the monthly bills. Cokel seconded the motion. All yeas.
Under new business, Smith informed the committee that he had submitted the county highway department’s bills from the August 23, 2007, debris cleanup in Village of Kirkwood and the City of Monmouth to each respective agency. Smith also informed the committee that FEMA will reimburse up to 75% of all costs incurred by the Village and City.

November 7, 2007
The committee met in conjunction with the Road and Bridge Committee.
Under old business, Cokel added a draft copy of the Animal Control Officer’s guidelines to the agenda. Gibson made a motion to approve the agenda. Cokel seconded the motion and it passed unanimously.
The October minutes were reviewed. Johnson made a motion to approve the minutes. Gibson seconded the motion and it passed unanimously.
The monthly bills were reviewed. Gibson made a motion to approve the bills. Cokel seconded the motion and it passed unanimously.
Under old business, Cokel presented a first draft of the Animal Control Officer’s guidelines to the committee. Cokel made a motion to table the guidelines until next month’s meeting so all committee members would have time to review the guidelines and offer comments. Johnson seconded the motion and it passed unanimously.
Under new business, Johnson made a motion to present the City/County Joint Animal Control Contract Agreement to the County Board for approval. Gibson seconded the motion and it passed unanimously.
Next under new business, the committee and John Livingston reached an agreement on the new contract for the Animal Control Warden. Johnson made a motion to present the Contract for the Animal Control Warden to the County Board for approval. Thompson seconded the motion and it passed unanimously.
Finally under new business, Thompson made a motion to present the Co-Animal Control Administrators Agreement to the County Board for approval. Johnson seconded the motion and it passed unanimously.

CITY/COUNTY JOINT ANIMAL CONTROL CONTRACT
AGREEMENT
THIS AGREEMENT entered into this 14th day of November, 2007, between the City of Monmouth, a Municipal Corporation, located in the County of Warren, State of Illinois, hereinafter referred to as "CITY", and the County of Warren, a Political Subdivision of the State of Illinois, located in the State of Illinois, hereinafter called "COUNTY".
WHEREAS, CITY AND COUNTY individually have certain responsibilities for control and/or care of abandoned or stray cats and dogs as required by local ordinance and/or State Statutes and
WHEREAS, CITY AND COUNTY desire to provide for the care of abandoned or stray cats and dogs in the most economical manner for the residents of their respective jurisdictions, and
WHEREAS, CITY AND COUNTY have, for the past several months, jointly operated an animal control shelter, which shelter was constructed by the COUNTY on land owned by the CITY, and
WHEREAS, CITY AND COUNTY desire to share said facility for the care of abandoned or stray cats and dogs.
NOW THEREFORE, in consideration of the mutual covenants and stipulations set forth herein, it is agreed as follows:
1. That CITY AND COUNTY will continue to jointly use the animal control shelter facility located in the City of Monmouth for the purpose of housing and caring for stray or abandoned cats or dogs, or cats and dogs running at large in violation of local ordinance and/or State Statute.
2. That CITY AND COUNTY shall, not less than quarterly, provide the other party with a written statement clearly showing all receipts and expenditures incurred in the operation of the shelter for the previous calendar quarter. The party with the least net operating expense for the preceding calendar quarter shall pay to the party
with greatest net operating expense a sum equal to one-half (1/2) of the difference shown on the respective quarterly statements. Said payment to be made within thirty (30) days of the end of each calendar quarter.
3. That the COUNTY'S income and expenses incidental to the issuance of dog licenses be wholly retained and borne by the COUNTY. 4. That the CITY'S income and expenses incidental to the issuance of cat licenses be wholly retained and borne by the CITY.
5. That each party to this Agreement shall assume and hold the other harmless for any and all liability arising by reason of the acts of their respective employees in the performance of this Agreement THIS INSTRUMENT contains the entire agreement between the parties and no statement, promises, or inducements made by either party or agent of either party that is not contained in this written contract shall be valid or binding; and this Agreement may not be enlarged, modified, or altered except in writing signed by the parties and endorsed thereon.
THIS AGREEMENT shall insure to the benefit and be binding upon the assignees and successors of the respective parties until November 30th, 2008. Notice of termination must be thirty (30) days before the expiration of contract by either party.

CONTRACT FOR SERVICES BY ANIMAL CONTROL WARDEN
This Contract is made by and between Warren County, a duly constituted County of the State of Illinois (COUNTY) and John A. Livingston, Animal Control Warden (WARDEN), pursuant to Livingston’s appointment as WARDEN by Dr. Elizabeth D. McBroom and Dr. Mark F. Hall, Animal Control Administrators (ADMINISTRATORS) for the COUNTY as authorized by the COUNTY BOARD. (Illinois Animal Control Act, Illinois Compiled Statutes, Chapter 510, Act 5, Section 1 et. Seq.)
WARDEN, an independent contractor, and COUNTY mutually promise and agree to the terms of this contract as follows:
1. DURATION AND TERMINATION OF CONTRACT:
A. This contract shall begin on December 1, 2007, and terminate on November 30, 2008, inclusive.
B. WARDEN or COUNTY may otherwise terminate this contract upon thirty (30) days written notice to the other party. Notice of termination pursuant to this subsection shall be made by personal service or via first class mail service.
C. Upon a breach of this contract, the non-breaching party may terminate this contract upon thirty (30) days written notice to the breaching party. Notice of termination pursuant to this subsection shall be made by personal service or via first class mail service. Notice of termination pursuant to this subsection shall become ineffective if the breaching party cures the breach within the thirty (30) days notice period.
2. COMPENSATION:
A. WARDEN shall receive compensation from COUNTY of twenty-five thousand dollars ($25,000) for the duration of this contract.
B. Payment shall be made in equal installments beginning Friday, December 14, 2007, and thereafter every other Friday.
C. Payment shall be made the first Friday of regularly scheduled payment upon early termination of this contract pro rated to the date early termination became effective.
3. PERFORMANCE BY WARDEN:
A. WARDEN shall devote as much time as reasonably necessary to fully perform WARDEN’S duties as required by the ADMINISTRATORS, COUNTY ordinances and the laws of the State of Illinois.
B. WARDEN may contract with other units of local government to provide animal control services.
4. VEHICLE AND VEHICLE ALLOWANCE:
A. WARDEN shall provide a vehicle that will allow WARDEN to reasonably perform the duties required under this contract.
B. WARDEN shall pay for all expenses related to the vehicle WARDEN has provided pursuant to this contract.
C. WARDEN shall purchase and keep in effect liability insurance on the vehicle provided by WARDEN pursuant to this contract. WARDEN shall provide COUNTY with proof of liability insurance. The minimum limits of such liability coverage shall be set by COUNTY.
D. WARDEN shall be paid a vehicle expense allowance of five thousand four hundred dollar ($5,400). Payment shall be made in equal installments beginning December 14, 2007, and thereafter every other Friday.
E. WARDEN has been paid a vehicle purchase allowance of two thousand one hundred dollars ($2,100). Should this contract be terminated prior to May 31, 2008, the COUNTY may exercise one of the following options:
i. Require WARDEN to transfer title of said vehicle to COUNTY upon payment by COUNTY to WARDEN of one hundred seventy-five dollars ($175) for each month this contract or a renewed contract was in effect. Payment shall be made within thirty (30) days of termination or non-renewal of this contract.
ii. Require WARDEN to pay to COUNTY one hundred seventy-five dollars ($175) for each month less than twelve (12) consecutive months that WARDEN is not under contract with COUNTY. Payment shall be made within thirty (30) days of termination of non-renewal of this contract.
F. Should WARDEN be under this contract or a renewed contract as WARDEN for twelve (12) consecutive months, COUNTY relinquishes any rights or claims to such vehicle pursuant to this section.
5. UNIFORMS AND EQUIPMENT:
A. COUNTY shall provide WARDEN with the following uniform clothing:
i. $100 per year clothing allowance
B. Patches for shirts, cap and jacket or coat that identifies WARDEN as WARREN COUNTY ANIMAL CONTROL WARDEN.
C. Uniforms and equipment shall be replaced on an as needed basis as determined by the ADMINISTRATORS and/or the Animal Control Warden.
D. All uniforms, equipment and patches purchased pursuant to this section are and shall remain the property of COUNTY.
6. EDUCATION AND TRAINING:
A. COUNTY shall pay the WARDEN’S initial training as required by the laws of the State of Illinois. Said training costs will be prepaid or reimbursed to WARDEN in an amount not to exceed one thousand two hundred dollars ($1,200). Payment shall cover the cost of tuition, mileage, housing and food. WARDEN shall provide adequate proof of costs to COUNTY to receive reimbursement or prepayment.
B. WARDEN shall reimburse COUNTY the cost of initial training as a rate of one- twenty fourth (1/24) for each month less than twenty-four (24) consecutive months that WARDEN is not under contract with COUNTY. Reimbursement shall be paid to COUNTY within thirty (30) days of termination of non-renewal of this contract.
C. WARDEN may attend one continuing education animal control program per year at COUNTY’S expense thereafter. Attendance at such animal control program shall be approved by the ADMINISTRATORS.
7. MISCELLANEOUS:
A. WARDEN shall be in uniform at all times while conducting animal control duties except under emergency situations where the changing of clothing would prevent WARDEN from promptly responding.
B. WARDEN shall provide for emergency animal control with a qualified individual or individuals during WARDEN’S absence. Said individual or individuals shall be approved by the ADMINISTRATORS.
C. WARDEN shall be responsible for all Federal, State and Local taxes and assessments accrued as a result of this contract.
D. WARDEN shall not be covered by COUNTY’S Workmen’s Compensation or eligible for any of COUNTY’S employee benefits.
E. This contract represents the entirety of the agreement for animal control between WARDEN and COUNTY. Modifications of this contract shall be in writing and will not require additional consideration.
8. SEVERABILITY:
A. Any part or parts of this contract that are found to be unlawful by decision of Illinois or United States Courts or by a change in Illinois or United States law shall have no effect on the remainder of the contract.

THIS MEMORANDUM EVIDENCES an Agreement made between Warren County, a duly constituted county of Illinois, hereinafter referred to as "COUNTY," and Dr. Elizabeth D. McBroom and Dr. Mark F. Hall, Veterinarians, hereinafter referred to as "CO-ADMINISTRATORS,"
Whereas, Warren COUNTY, pursuant to recently enacted statutes is required to provide for an Animal Control Program, and
WHEREAS, said CO-ADMINISTRATORS shall provide a service as hereinafter mentioned in this Agreement for the County in return for the compensation provided herein.
NOW THEREFORE, the undersigned in consideration of their mutual promises, herein agree that:
1. The term of this agreement shall be from the 1st day of December, 2007, to and
including the 1st day of December, 2008.
2. That, for the terms of this Agreement, said CO-ADMINISTRATORS shall receive a
payment in the amount of One Thousand Eight Hundred and no/100 Dollars
($1,800.00), to be paid by the COUNTY over a twelve (12) month period, or as
otherwise agreed until the termination of this Agreement.
3. The CO-ADMINISTRATORS shall be responsible for the complete administration of the
animal control for Warren COUNTY, except those municipalities and villages
providing a satisfactory program of animal control in regard only to an animal
program at large, but not as to rabies control.
4. The CO-ADMINISTRATORS shall delegate all duties and supervise all work of the
Animal Control Warden.
5. This Agreement shall incorporate all applicable provisions of the Illinois Animal
Control Act effective October 1, 1978, and any subsequent law thereafter
applicable to the subject matter of this agreement.

The meeting was called to order by committee Chairman Russell Stanton. Also present were Todd Winkler, Karen Starbuck, Bob Kinsel and County Board Chairman Bill Reichow.
PRESENTATIONS FROM THE FLOOR
State’s Attorney Albert “Chip” Algren informed the committee that he will be replacing the carpet in his office with fees he has collected and placed in the County Offices fund.
REPORT OF OFFICEHOLDERS
Tina Conard, County Clerk and Recorder reported that she has received notification that a check for $14,000 has been issued for wind damage to the courthouse roof. Her office will soon be getting into election mode for the February 5, 2008, General Primary Election.
Janice Hamberg, Supervisor of Assessments reported on a tele-institute conference she attended. Copies of the basis of HB 664 were given to committee members. She discussed the work that involves her office in preparing for the HB 664 changes.
Treasurer Nancy Clayton noted that the County General balance as of October 31 is $514,432.86. She is expecting $50,000-$55,000 more to come from the final distribution, but the borrowed funds still need to be repaid. She gave the Animal Control Fund balance of $29,141.60 and asked Mr. Reichow to relay to the Animal Control Committee that $4,390.00 of that balance belongs to the State of Illinois for the non-altered fee imposed several years ago. The Warren County Housing Authority notified Mrs. Clayton of an empty lot at 1000 East 6th Avenue that the county sold at the silent auction; however, the deed still has not been recorded. There is a huge tree down on the lot and the Housing Authority is worried that it could be a problem with kids playing on it. Mr. Reichow will talk to Kevin Smith, at the county highway office, about the possibility of getting rid of the fallen tree. Her office is working on the final distribution and end of the year reports. One of her deputies, Bev Cox will be retiring after twenty plus years of service and Mrs. Clayton invited the committee members to an open house for Mrs. Cox on November 30 from 2:00 - 4:00 P.M.
County Board Chairman Bill Reichow reported on several meetings he had attended yesterday on a home modification grant and one on Highway 34. He invited members to another telenet conference on Alternative Energy November 15 from 3:00 - 5:00 P.M. The MET tower is up on the county farm and an offer has been made for a fourth tower to be placed.
Three bids for the Warren County farm lease were opened:
Jon Graham at $221.50 per acre
LPT Farms at $231.77 per acre
Stephen Hawkins at $230.72 per acre.
Mrs. Starbuck made a motion to accept the high bid of $231.77 per acre from LPT Farms. Mr. Kinsel seconded the motion.
Committee Chairman Stanton mentioned that Ron Moore, Chairman of the Zoning Board of Appeals, will be available at the county board meeting next week to answer questions on the Wind Energy Restoration Agreement. The committee asked to have a Kone Elevator representative at the December meeting to discuss their annual elevator safety test inspection proposal. Mr. Winkler made a motion to allow $200 be spent for Ron Coons to place green garland around the light poles for the holiday season. Mrs. Starbuck seconded the motion, voice vote passed. Mr. Stanton also mentioned that R.L. High will begin roof repairs next week.
Bills were reviewed and paid on a motion by Mr. Winkler and seconded by Mrs. Starbuck.

The lease is for a three year term beginning March 1, 2008, and ending February 28, 2011, for a sum of $42,191.64 per year with $21,095.82 paid on or before March 1 of each year and the balance of $21,095.82 paid on or before November 1 of each year. SPECIAL FINANCE COMMITTEE MEETING
October 30, 2007
The special meeting of the Finance Committee was called to order by committee Chairman Mike Pearson. Also present were Gary Heaton, John Turnbull, Dave Jenks and County Board Chairman Bill Reichow. Other county board members were also present.
Mr. Pearson explained the reason for holding the special meeting was to discuss ideas and suggestions to increase revenue and cut expenses. There were several suggestions, such as, reducing the hours of the courthouse, a public safety tax, a public building commission or selling some county properties.
Supervisor of Assessments Janice Hamberg suggested the board appoint one or two members to a Legislative Committee to keep up with legislation that concerns the county. She also learned that the first full week in March of each year has been designated as Local Government Week, and that the county should use this opportunity to promote the county and the services the county provides.
Treasurer Nancy Clayton talked about the Indemnity Fund. Monies in this fund are collected from tax sale fees and can only be used for lawsuits against the county for property sold in error. Any amount over $50,000 or 3/10%, whichever is greater, can be turned in to County General. There is currently $215,000 in the fund. There were several suggestions on what to do with the money.
Mr. Pearson asked Building and Grounds Chairman Rusty Stanton or someone on the Buildings and Grounds Committee to get in touch with the City of Monmouth on looking for alternative energy sources other than Ameren.
The committee then reviewed the tentative budget line by line and made some changes. Further review will resume at their regularly scheduled November 8 meeting.

State’s Attorney Albert “Chip” Algren informed the committee that his office has collected funds from fines which have been deposited in the County Offices fund. He is purchasing new carpet for his office which will be paid from the County Offices Fund line.
REPORT OF OFFICE HOLDERS
County Clerk Tina Conard reported to the committee that three bids were received for the County Farm with LPT Farms being the highest bid at $231.77 per acre. She has received notice that the $14,000 check for storm roof damage has been issued, though she has not received it. Her office will soon be preparing for the February 5, 2008,General Primary, Election and may very well be doing absentee voting during the holidays.
Sheriff Edwards mentioned that the Village of Roseville police contract will be renewed.

Mrs. Clayton discussed the Trust Fund with a balance of $12,169.08. This fund is only used for court cases on chancery, if interest is not requested it remains with the county. Mrs. Clayton is looking into allowing transfer of this money to County General. Mrs. Clayton also invited the committee to an open house on November 30 from 2:00 - 4:00 P.M. for Bev Cox, a retiring employee.
Janice Hamberg, Supervisor of Assessments reported on a telenet conference and the Chamber’s Legislative lunch she had attended. Her office is waiting on the new exemption forms from the Department of Revenue before she can begin processing some of the new exemptions from HB 664.
County Board Chairman Bill Reichow reported on several meetings he had attended. He reminded members of an Alternative Energy program on November 15 from 3:00 - 5:00 P.M.
The committee reviewed a list of properties sold at the Warren County Trustee’s silent bid auction. Mr. Jenks made a motion to approve the sale of these properties and to recommend the sales to the county board. Mr. Heaton seconded the motion and on voice vote motion carried. Mrs. Clayton reported that the State’s Attorney says no resolution is needed to transfer funds from the Indemnity Fund to the County General fund because the laws allow for such.
Bills were reviewed and paid on a motion by Mr. Jenks and seconded by Mr. Heaton. Mr. Jenks questioned the County Farm lease regarding lime stone treatment.
With no further business the Finance Committee adjourned on a motion by Mr. Heaton and seconded by Mr. Jenks.
The committee then resumed budget work. The committee discussed and reviewed the budget and made some changes. Mr. Heaton moved to go into closed session to discuss the employment of a public defender. This motion is made under the open meetings act, Chapter 5, Act 120, Section (c) (1) employment of legal counsel. Mr. Jenks seconded the motion.
Mr. Jenks made a motion to come out of closed session. Mr. Jenks moved to allow the Finance Chair the ability to negotiate a yearly fee with the Public Defender. Mr. Heaton seconded the motion. On voice vote, motion carried.
Mr Heaton made a motion to take the revised tentative budget to the full county board. Mr. Jenks seconded the motion. Motion carried.
Mr. Heaton made a motion to take the proposed levy to the full county board. Mr. Jenks seconded the motion. Motion carried.
Mr. Jenks made a motion to adjourn the budget meeting. Mr. Heaton seconded the motion and on voice vote motion carried.

WARREN COUNTY TAX AGENT PROPERTY RESOLUTION
This resolution is a list of purchasers and properties sold at the sealed bid auction by the Warren County Tax Agent on September 6, 2007. These are properties for which the agent had taken deeds and were sold at the auction. There were twenty properties sold to various persons for a total collected of $17,913.00. There were recording fees of $1,520.00 and Tax Agent Fees of $5,627.25 with the balance of $10,765.75 to the Warren County Treasurer. The complete list of item numbers, purchasers and amounts are on file in the county clerk’s office.

RESOLUTION #41-06-07
ZONING CO-ADMINISTRATORS
AGREEMENT
PURPOSE:
This agreement is entered into between Warren county, Illinois, (hereinafter referred to as “County”) and Marcia K. McLaughlin and Tammy Davis (hereinafter referred to “Co-Administrators”), whereby the Co-Administrators shall administer County’s zoning ordinance and County’s plats on behalf of the County.
TERM:
This agreement shall commence December 1, 2007, and terminate November 30, 2008, inclusive. Either party may terminate this agreement early by giving sixty (60) days written notice to the other party. This agreement may be terminated at any time by the mutual agreement of the parties.
CONSIDERATION:
County shall pay each Co-Administrator $3,264 per year in consideration of administering County’s zoning ordinance and plats. Said compensation shall be paid in twenty-six (26) equal installments to be paid on County’s regularly scheduled pay days. The annual consideration shall be pro-rated should this agreement be terminated early.
DUTIES AND AUTHORITIES OF CO-ADMINISTRATORS:
1. To administer County’s zoning ordinance and plats in a prompt and timely fashion.
2. To maintain office hours that correspond with County’s.
3. To report to the County Board on a monthly basis. Such report will include the number and type of building permits issued in Warren County for the previous month and year to date and the approximate value of the structures represented by said permits.
4. To record the minutes of every meeting held by County’s Zoning Board of Appeals and Planning Commission.
5. To provide for site inspections at an annual rate not to exceed $5,000 per year.
6. To report to the Zoning Board of Appeals, Planning Commission, County Board and State’s Attorney regarding any problems or interpretation issues regarding County’s zoning ordinance.
DUTIES OF COUNTY:
1. Provide the Co-Administrators with appropriate office space which will include a minimum of one (1) telephone line.
2. Provide the Co-Administrators with adequate office supplies.

LEGAL COUNSEL FOR INDIGENTS AGREEMENT
This Agreement is entered into this 14th day of November, 2007, by and between the County of Warren, a political subdivision of the State of Illinois located in the State of Illinois, hereinafter referred to as "Warren County" and Stansell, Whitman & Baber acting only through Thomas Siegel, an attorney duly licensed to practice law in the State of Illinois, hereinafter referred to as "Thomas Siegel";
WITNESSETH:
WHEREAS, Warren County is desirous of contracting with independent counsel to provide legal services to indigent and juvenile persons appearing in criminal, juvenile and traffic cases in the courts of Warren County; and
WHEREAS, Thomas Siegel is an attorney desirous of contracting through Stansell, Whitman & Baber, on an independent basis, with Warren County to provide legal services as specified herein;
NOW THEREFORE, WARREN COUNTY and Thomas Siegel through Stansell, Whitman & Baber agree as follows:
1. TERM: The term of this Agreement shall be from December 1, 2007, to November 30, 2008.
2. PAYMENT: WARREN COUNTY agrees to pay to Thomas Siegel the sum of $60,000, to be paid in 26 equal payments, the first of which shall be made on December 14, 2007, and continuing thereafter every two weeks until termination of this Agreement.
3. SERVICES: In consideration of the payments set forth herein, Thomas Siegel agrees to provide legal services to indigents and juveniles in criminal and juvenile cases in the courts of Warren County, upon appointment by the Court. Cases are to be assigned as follows:
A. All felony cases, subject to the exceptions set forth below.
B. All misdemeanor cases, except driving offenses unless an unrelated felony is also charged.
C. All Juvenile cases where a conflict exists for the alternate independent counsel who contracts with Warren County for representation of indigent persons and juveniles and in all juvenile cases where more than one attorney is appointed.
D. Exceptions:
I. Thomas Siegel is not responsible for representation of defendants in traffic, first degree murder or capital cases.
II. Thomas Siegel is not responsible for representation of defendants in civil actions or administrative proceedings brought by Warren County or the State of Illinois.
III. Thomas Siegel is not responsible for representation of defendants taking cases on appeal.
E. Should Thomas Siegel be appointed by the Court to represent defendants in any cases from which he has been excepted, Thomas Siegel shall bill Warren County for reasonable fees for such representation.
4. LEGAL SERVICES: Legal services to be provided shall be those services ordinarily and customarily provided by a public defender to persons in criminal and juvenile cases, both prior to and through trial in the courts of Warren County.
5. SUPPORT SERVICES: Thomas Siegel shall provide and pay for all assisting counsel, support staff, secretarial assistance, supplies, material, travel (unless venue is changed by the court), equipment, and office expense unless otherwise ordered by the Court. This shall not include costs for subpoenas or expert witnesses or other costs directly related to an individual case.
6. TERMINATION: This Agreement may be terminated by either Warren County or Thomas Siegel upon 60 day written notice.
7. WITNESS SUBPOENA ACCOUNT: Thomas Siegel will advance money for witness and mileage fees related to the issuance of subpoenas and will then periodically submit a statement to the Warren County Treasurer for reimbursement of the advanced above mentioned fees.

WHEREAS, Warren County is desirous of contracting with independent counsel to provide legal services to indigent and juvenile persons appearing in criminal, juvenile and traffic cases in the courts of Warren County; and
WHEREAS, Sherry R Lawson is an attorney desirous of contracting, on an independent basis, with Warren County to provide legal services as specified herein;
NOW THEREFORE, WARREN COUNTY and Sherry R Lawson agree as follows:
1. TERM: The term of this Agreement shall be from December 1, 2007, to November 30, 2008.
2. PAYMENT: WARREN COUNTY agrees to pay to Sherry R Lawson the sum of $37,800.00 to be paid in 12 equal payments, once a month, until termination of this Agreement.
3. SERVICES: In consideration of the payments set forth herein, Sherry R Lawson agrees to provide legal services to indigents and juveniles in criminal, juvenile and traffic cases in the courts of Warren County, upon appointment by the Court. Cases are to be assigned as follows:
A. All felony cases, subject to the exceptions set forth below, in which Warren County’s Independent Counsel, whose primary duty is to represent felony defendants, has a conflict.
B. All misdemeanor cases in which Warren County’s Independent Counsel, whose primary duty is to represent misdemeanor defendants, has a conflict.
C. All Juvenile cases in which Sherry R Lawson does not have conflict. With regard to juvenile neglect and abuse cases, Sherry R Lawson shall be first appointed as Guardian Ad Litem whenever possible.
D. All traffic cases in which Sherry R Lawson does not have a conflict.
E. Exceptions:
I. Sherry R Lawson is not responsible for representation of defendants in first degree murder or capital cases.
II. Sherry R Lawson is not responsible for representation of defendants in civil actions brought by Warren County or the State of Illinois.
III. Sherry R Lawson is not responsible for representation of defendants taking cases on appeal.

Representation shall end thirty (30) days after sentencing or conviction or immediately upon dismissal of a case.
5. SUPPORT SERVICES: Sherry R Lawson shall provide and pay for all assisting counsel, support staff, secretarial assistance, supplies, material, travel, equipment, and office expenses unless otherwise ordered by the Court.
6. COURT APPEARANCES: Court appearances for Sherry R Lawson shall be set only on Mondays and Thursdays of each week, with the exception of jury trials and the jury pretrial hearings as set by the criminal jury judge.
7. VACATIONS: Sherry R Lawson shall be entitled to three (3) weeks of vacation per year. Sherry R Lawson shall be paid during those vacation periods and shall not have to provide coverage for those periods. Warren County shall keep those vacation periods free from all court appearances. Sherry R Lawson shall provide a minimum of two (2) weeks notice to Warren County of her intention to schedule vacation time. Vacation shall be taken either consecutively or non-consecutively.
8. TERMINATION: This Agreement may be terminated by either Warren County or Sherry R Lawson upon 60 day written notice.

RESOLUTION #46-06-07
BOARD RESOLUTION
Resolution authorizing application and execution of a Public Transportation Capital Assistance Grant under the Illinois Department of Transportation’s general authority to make such Grants.
WHEREAS, the provision of general public and specialized paratransit service is essential to the transportation of elderly, disabled and other transportation disadvantaged persons; and
WHEREAS, the Illinois Department of Transportation’s general authority to make such Grants, makes funds available to offset certain capital costs of a general public transportation system; and
WHEREAS, grants for said funds will impose certain obligations upon the recipient.
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BOARD OF THE WARREN COUNTY:
Section 1. That an application be made to the Division of Public and Intermodal Transportation, Department of Transportation, State of Illinois, for a financial assistance grant under the Illinois Department of Transportation’s general authority to make such Grants, for the purpose of off-setting certain general public transportation capital costs of WARREN COUNTY.
Section 2. That William Reichow, Board Chairman, an employee or board member of WARREN COUNTY is hereby authorized and directed to execute and file such application on behalf of WARREN COUNTY.
Section 3. That William Reichow, Board Chairman of WARREN COUNTY is authorized to furnish such additional information as may be required by the Division of Public Transportation in connection with the aforesaid application for said grant.
Section 4. That William Reichow, Board Chairman of the WARREN COUNTY is hereby authorized and directed to execute and file on behalf of the WARREN COUNTY any grant agreement pursuant to said application.

CHAIRMAN’S COMMENTS
Chairman Bill Reichow again asked the board members to contact their legislators to support the Capital Bill. Mr. Reichow talked about two meetings he had attended with F.E.M.A. and I.E.M.A.
Treasurer Nancy Clayton invited the county board to attend the retirement party for Bev Cox on November 30 from 2:00 - 4:00 P.M. Mrs. Cox is retiring after twenty years of service to the county.
